| Acceptable Use Policy             | The acceptable use policy for KOADX is found in the footer of this website. |
| ADDITIONAL SERVICES               | Any additional services (such as consultancy or training) which NionNet may agree to provide, being any services other than those included in the Package or Bespoke Template Creation Services, which may be ordered together with your Package or subsequently. |
| BESPOKE TEMPLATE                  | A bespoke template which NionNet creates for the Customer as part of the Bespoke Template Creation Services. |
| Bespoke Template Creation Services  | The creation of Bespoke Templates for the Customer, as described in the Terms and Conditions found in the footer of this website. |
| COMPATIBLE BROWSER                | The latest general release version of Chrome, Microsoft Edge, Firefox or Safari, in each case provided that the browser has no non-standard plug-ins and is configured in accordance with the default settings applicable to that browser, or any other configuration which may be specified as required in the Documentation from time to time. |
| CUSTOMER                           | The entity which subscribes to KOADX, being the entity named in the registration form. |
| Customer Application               | An application created, developed or maintained by the Customer (or a company in the Customer's Group) into which the Customer incorporates Generated Code. |
| Customer Branding                  | The Customer's name, logo and any other trademark or branding of the Customer. |
| Customer Content                   | Any content which belongs to the Customer, including any of the Customer's own code included within the Customer Application and any other content or materials which the Customer provides to NionNet. |
| Data Protection Legislation        | The Data Protection (Baillickw of Guernsey) Law 2017 and (a) if the Customer is based in the UK, the UK GDPR and (b) if the Customer is based in the EEA, the EU GDPR, together with any other applicable data protection legislation as may be in force from time to time. |
| Documentation                      | The user documentation which describes KOADX and provides guidance as to its proper use. |
| Fees                               | Any fees notified during the registration process, or which are otherwise payable, in accordance with these terms. |
| Generated Code                    | Any code generated by KOADX for the Customer, as described in the Terms and Conditions found in the footer of this website. |
| Group                              | A company and each of its subsidiary companies from time to time and, if the company is not the ultimate holding company, its ultimate holding company and each of its ultimate holding company's subsidiary companies from time to time, "holding company" and "subsidiary" having the meanings given to them in section 531 of the Companies (Guernsey) Law 2008. |
| Intellectual Property Rights        | Any and all intellectual property rights including patents, trademarks, copyright, rights in databases, domain names, know-how, look and feel, rights in confidential information and all similar rights (whether or not registered or capable of registration and wherever in the world subsisting) together with the right to apply for registration of and/or register such rights and any and all goodwill relating or attached to it and all extensions and renewals of it. |
| NionNet                            | NionNet Limited, a company registered in Guernsey with registered number 68698 and with its registered office located at Les Amareurs, La Biloterie Road, Perelle, St Saviour's, Guernsey, GY7 9QY. |
| KOADX                              | The automated code generation product offered by NionNet, described in more detail in the Documentation. |
| Package                            | The project or subscription package chosen by the Customer entitling the Customer to access and use KOADX in accordance with these terms (subject to payment of the Fees), which includes the rights set out in the Terms and Conditions found in the footer of this website. |
| Services                           | The services which NionNet provides to the Customer under these terms, including any services included within the Package, any Bespoke Template Creation Services and any Additional Services which AppCheck may agree to provide from time to time. |
| Support                            | The support which NionNet provides to the Customer in respect of its use of KOADX, which is more fully described in the service level agreement available on this website. |
| User                               | An individual person who accesses KOADX as part of the Customer's Package. |
| Working Day                       | Any day other than a Saturday, Sunday or public holiday in the UK. |
| Working Hours                     | 9am to 5pm (local time in the UK) on a Working Day. |
